This Legal page outlines the Terms & Conditions and Privacy Policy governing the use of EvacNow services and website.

By using our website, requesting a quote, or placing an order, you agree to the terms outlined below.

1. Terms & Conditions

1.1 Services

EvacNow provides professionally prepared evacuation diagrams and related fire safety documentation based on information supplied by the client.

Evacuation diagrams are prepared in accordance with AS 3745 – Planning for emergencies in facilities, using the details, floor plans, mark-ups, photographs, and site information provided at the time of order.

Unless expressly agreed in writing, EvacNow provides services remotely and does not conduct onsite inspections.

1.2 Client Responsibilities

You acknowledge and agree that:

  • All evacuation diagrams are produced solely from the information you provide.

  • You are responsible for ensuring all supplied floor plans, mark-ups, photographs, measurements, and other details are accurate, complete, and current.

  • Evacuation diagrams prepared remotely should be verified onsite prior to printing, installation, and use.

  • Final responsibility for legislative compliance, installation location, and suitability for the premises rests with the building owner, occupier, manager, or other responsible entity.

  • EvacNow is not liable for errors, omissions, or compliance issues arising from incorrect, incomplete, outdated, or unclear client-supplied information.

1.3 Revisions

One minor revision may be included to correct drafting errors made by EvacNow.

Any revisions resulting from updated plans, new photographs, changed site details, client design requests, or additional information supplied after work has commenced may incur additional fees.

Where significant changes are required, EvacNow may determine that a new diagram order is necessary.

1.4 Fees and Payment

All prices are in Australian Dollars (AUD) and are exclusive of GST, unless stated otherwise.

A design or setup fee may apply to all orders. Printing, framing, premium materials, delivery, and any additional revisions are charged separately where applicable.

Payment is required prior to final delivery unless otherwise agreed in writing.

EvacNow reserves the right to withhold final files, printed materials, or delivery until payment has been received in full.

Minimum order quantities may apply to some products or printing options.

1.5 Delivery

Standard delivery is by high-resolution, print-ready PDF unless otherwise specified.

Where selected, printed diagrams, snap frames, or other display materials will be supplied separately and charged accordingly.

Any delivery timeframes provided by EvacNow are estimates only and may vary depending on order complexity, order volume, third-party supplier lead times, and client response times.

EvacNow is not liable for delays caused by incomplete information, delayed approvals, courier issues, or circumstances outside our reasonable control.

1.6 Installation

Unless expressly agreed in writing, EvacNow does not provide installation services.

Where printed diagrams or snap frames are supplied, the client is responsible for installation unless installation has been separately quoted and accepted.

Any installation guides or recommendations provided by EvacNow are general in nature only. The client remains responsible for confirming suitable mounting locations, fixing methods, wall conditions, and final installation compliance onsite.

1.7 Intellectual Property

EvacNow retains ownership of all original design files, source files, working files, templates, and drafting layouts created as part of the service.

Upon full payment, the client is granted a non-exclusive, non-transferable licence to use and display the final evacuation diagrams at the nominated premises only.

Evacuation diagrams may not be copied, altered, reused at another site, resold, distributed, or reproduced in any form without prior written permission from EvacNow.

1.8 Limitation of Liability

To the maximum extent permitted by law:

  • EvacNow is not liable for any indirect, incidental, special, or consequential loss or damage.

  • EvacNow does not warrant or guarantee approval by regulators, certifiers, auditors, fire authorities, building authorities, or any other third party.

  • EvacNow’s total liability for any claim relating to the supply of services is limited to the amount paid by the client for the relevant service.

Nothing in these terms excludes any rights that cannot be excluded under Australian Consumer Law.

1.9 Cancellations and Refunds

Orders cancelled after work has commenced are not eligible for refund.

Refunds are not provided for change of mind, delays caused by the client, or where the client no longer wishes to proceed after drafting or setup has begun.

If EvacNow is unable to deliver the agreed service for reasons within our control, a partial or full refund may be provided at our discretion.

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any disputes arising in connection with EvacNow services or website use will be subject to the jurisdiction of the courts of Queensland.
