EvacNow – Terms of Service

These Terms of Service explain how EvacNow’s evacuation diagram services operate. By accepting a quote, paying a deposit, placing an order or instructing us to begin work, you agree to these terms.

1. Our services

EvacNow prepares evacuation diagrams with reference to AS 3745–2010 and its current amendments, based on the information available and the services included in your accepted quote.

Depending on the option selected, our services may include:

  • Digital delivery of print-ready PDF diagrams
  • Printing and supply of diagrams
  • Supply of aluminium snap frames
  • Delivery
  • On-site assessment, measurement or photography
  • Installation at the nominated premises

Only the services listed in the accepted quote are included.

2. Information and site access

To prepare the diagrams, you may be required to provide floor plans, photographs, site details, emergency equipment locations, exits, assembly areas and other relevant information.

You are responsible for:

  • Providing accurate, complete and current information
  • Advising us of known building or layout changes
  • Ensuring we have permission to access, photograph or work at the premises
  • Providing safe and reasonable site access at the agreed time
  • Reviewing the draft diagrams against actual site conditions
  • Identifying any errors or required changes before final approval

EvacNow is not responsible for errors or delays caused by inaccurate, incomplete or outdated information supplied by you or someone acting on your behalf.

3. Preparation and approval

Our usual process is:

  1. You provide the required information or arrange a site visit
  2. EvacNow prepares the diagrams
  3. Draft diagrams are issued for review
  4. You review the drafts and request any changes
  5. You approve the diagrams
  6. Final files or printed products are supplied

Approval may be provided by email or another agreed written method. Once approved, the diagrams will be treated as final.

4. Revisions and alterations

The number of revisions included will be stated in your quote.

Additional fees may apply where:

  • Changes exceed the revisions included
  • New information is provided after drafting has commenced
  • The building layout, equipment or original scope changes
  • A diagram needs to be substantially redrawn
  • Alterations are requested after final artwork has been approved or issued

Alterations requested after final delivery may incur a reopening and revision fee because the artwork must be returned to production. We will advise you of any additional fee before completing chargeable work.

If an error was made by EvacNow, we will correct it without an additional design fee.

5. Pricing and payment

All prices are in Australian dollars and exclude GST unless stated otherwise.

Payment requirements will be shown in the quote and may include:

  • Full payment before final digital files are released
  • A deposit before printing, frame supply or installation is scheduled
  • Payment of the remaining balance before delivery, installation or final handover

Work may be paused if an invoice is overdue. EvacNow may withhold final files, printed products or installation until the applicable payment requirements have been met.

Additional work outside the accepted scope will be quoted or approved before proceeding.

6. Timeframes

Any completion, printing, delivery or installation date is an estimate unless expressly agreed otherwise in writing.

Timeframes may be affected by:

  • Delays in receiving information, feedback, approval or payment
  • Printing or supplier availability
  • Courier or freight delays
  • Site access issues
  • Changes to the agreed scope
  • Events outside our reasonable control

We will keep you informed if a material delay occurs.

7. Printing, frames and delivery

Printed diagrams, snap frames and delivery are included only where listed in the quote.

You must notify us promptly if printed products arrive damaged, defective or materially different from the approved artwork. Photographs may be required so we can assess the issue.

We are not responsible for printing errors resulting from artwork or information that you approved, except where the error was introduced by EvacNow or its supplier after approval.

8. Installation

Installation is included only when specifically listed in the quote.

Where EvacNow installs the diagrams, you are responsible for:

  • Confirming that we have permission to fix items to the relevant walls or surfaces
  • Advising us of concealed electrical wiring, plumbing, hazardous materials or other risks
  • Providing safe and unobstructed access to the installation locations
  • Obtaining any landlord, body corporate, building management or other approval required

EvacNow will take reasonable care when installing diagrams. We are not responsible for pre-existing defects, unsuitable wall surfaces or concealed services that were not disclosed or reasonably apparent.

Where installation is not included, any installation guide we provide is general guidance. You remain responsible for ensuring each diagram is correctly positioned, oriented, securely displayed and unobstructed.

9. Compliance

EvacNow prepares diagrams with reference to AS 3745–2010 and its current amendments, using the site information supplied or observed within the agreed scope.

Compliance also depends on factors outside the diagram artwork, including:

  • The accuracy of the information available
  • The diagram’s installation position and orientation
  • Current site conditions
  • Changes made after preparation
  • The facility’s broader emergency planning arrangements

We do not guarantee acceptance or approval by a regulator, certifier, auditor or other third party. However, we will perform the agreed services with due care and skill and address any issue for which EvacNow is responsible.

10. Ownership and permitted use

EvacNow retains ownership of its working files, templates, design systems and production files.

Once all applicable invoices are paid, you receive a non-exclusive licence to use the final diagrams at the premises identified in the quote.

You may print reasonable replacement copies for that premises unless your quote states otherwise. You must not:

  • Edit or alter the diagrams without written permission
  • Remove EvacNow’s identification or branding
  • Reuse the diagrams for another premises
  • Resell, sublicense or commercially redistribute the diagrams
  • Provide editable or production files to another supplier for modification

Written permission is required for uses outside this licence.

11. Cancellations

If you cancel before work commences, any payment made will generally be refunded, less any non-refundable costs already incurred.

If you cancel after work has commenced, EvacNow may charge for:

  • Work completed up to the cancellation date
  • Software, drafting or production costs already incurred
  • Printing, frames, freight or other products already ordered
  • Booked site attendance or installation costs where reasonable notice was not provided

Any remaining balance will be refunded where applicable.

Custom-printed or specially prepared products cannot generally be refunded for change of mind once production has commenced.

12. Australian Consumer Law and liability

Our services and products come with rights and guarantees that may apply under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

To the maximum extent permitted by law, EvacNow is not responsible for indirect or consequential loss arising from inaccurate client-supplied information, undisclosed site conditions, incorrect installation by others, unauthorised alterations or changes to the premises after the diagrams were prepared.

Where liability can lawfully be limited, EvacNow’s liability will be limited, at our option, to:

  • Correcting or supplying the affected services again; or
  • Paying the reasonable cost of having the affected services supplied again

Nothing in these terms removes EvacNow’s responsibility to perform its services with due care and skill.

13. Privacy and confidentiality

We may collect contact information, plans, photographs, addresses, access details and other project information needed to quote, prepare and deliver our services.

Information may be disclosed to service providers where reasonably required, including drafting, software, printing, delivery, payment and IT providers. We do not sell personal information.

14. Changes to these terms

We may update these terms occasionally. The terms applying to an order will generally be those available when the relevant quote was accepted, unless a change is required by law or agreed with you.

15. Governing law

These terms are governed by the laws of Queensland, Australia. Before commencing formal proceedings, both parties agree to make a reasonable attempt to resolve any dispute directly and in good faith.
